General Provisions
These Terms govern use of the propercheck.pl Service — a SaaS platform for email address verification (web panel, API, bulk CSV verification).
- These Terms comply with the Act on the Provision of Electronic Services
- The Service is intended for businesses and professionals (B2B). By using the Service, you declare that you act in connection with business or professional activity, unless mandatory law provides otherwise
- Every user must read these Terms and the Privacy Policy before registration
- 1 credit = 1 email verification (POST /api/v1/verify or equivalent panel action)
Electronic Services Provided
User account
The Service allows you to create an account with access to the panel, verification history, credit balance, API keys, and webhooks. Registration requires an email address and password (min. 12 characters). The account is activated after clicking the verification link. Free trial credits may be granted after registration — details in the Service.
Single and bulk verification
You may verify single email addresses in the panel or upload a CSV/XLSX file for bulk verification. Each unique verification consumes 1 credit. Results include status (valid, invalid, risky, catch-all, unknown) and score, depending on the verification engine.
API and webhooks
You may generate API keys for integration with your systems and configure outbound webhooks notifying about completed verifications. API use is subject to rate limits published in the API documentation.
Credits and Payments
Pay-as-you-go model
The Service operates on prepaid credits. Credit packs and prices are shown in the Service (/cennik, credits panel). Purchased credits do not expire unless these Terms state otherwise.
Payment
Payment for credit packs is processed via Stripe (payment cards). After payment is credited, credits are added to your account balance. VAT invoices are issued according to details provided at checkout.
No subscription
The Service does not require a monthly subscription. Fees are charged only for purchased credit packs and verifications actually performed.
Nature of verification results
Email verification is based on syntax, DNS/MX analysis, and — where possible — SMTP dialogue. Results are probabilistic and do not guarantee deliverability. We strive to keep results current, but an address status may change after verification.
- “Valid” does not guarantee marketing mail reaches the inbox (spam filters, provider policies)
- “Catch-all” indicates risk — the sending decision is yours
- Re-verifying the same address may consume another credit unless a cached result is returned per API documentation
Permitted and prohibited use
You may not use the Service unlawfully or in breach of these Terms.
- Verifying lists without a lawful GDPR / marketing law basis
- Circumventing API limits, attacking infrastructure, or reverse engineering the verification engine
- Sharing API keys with unauthorised persons
- Using the Service for spam, phishing, or harassment
- Scraping the web panel outside the documented API
Right of Withdrawal
Where you are a consumer, we inform you about the right of withdrawal. Digital credits activated on the account may be treated as digital content supplied immediately — before payment you are informed about loss of the withdrawal right once performance begins and you consent to immediate credit grant (checkbox at checkout). Consumer provisions apply only where you do not act as a business.
Complaints
Complaints regarding the Service, credit billing, or payments may be sent to the operator’s contact email. Include a problem description, date, and — if applicable — Stripe session identifier. We respond within 14 business days of receiving a complete complaint.
- Incorrect credit grant after a paid transaction
- Technical failure preventing verification despite sufficient balance
- Account or API access issues on the Service side
Liability
We are liable for proper provision of the verification service under these Terms. Liability to business users is limited to the fee for the credit pack from which the disputed verification originated, except for intentional damage, within mandatory legal limits. We are not liable for consequences of sending messages based on verification results or for your marketing decisions.
Intellectual Property
Service software, API documentation, scoring algorithms, branding, and marketing materials remain the operator’s property. You receive a non-exclusive licence to use the Service under these Terms. Verification results may be used in your business with respect for third-party rights and the GDPR.
Account Suspension
We may suspend or delete accounts for Terms breaches, API abuse, chargebacks without grounds, or legal obligation. We notify by email where possible. Unused credits may be voided in case of serious breach — proportionately and as permitted by law.
Changes to Terms
We may amend these Terms for material reasons (law, features, pricing). Material changes are announced at least 14 days in advance by email and in the Service. Continued use after the effective date means acceptance unless you delete the account earlier.
Governing Law and Disputes
Polish law applies. Disputes with businesses are resolved by the court competent for the operator’s seat, unless mandatory law provides otherwise. Consumers may use out-of-court complaint mechanisms (including the EU ODR platform).
Final Provisions
Invalidity of one provision does not affect the rest. These Terms together with the privacy policy constitute the entire agreement regarding use of the platform.
